KGW Gumbo, LLC, a Florida limited liability company (“we”, “our” or “us”), owns and operates the CreditGumbo.com web site. We take your privacy very seriously. By accessing or using the CreditGumbo.com web site and/or any of its pages, features, forums, widgets, buttons or web properties (collectively, the “Web Site”), you indicate your acknowledgement and acceptance of the Terms of Use provided on the Web Site, and you also agree that you have read, understand and agree to the terms of this CreditGumbo.com Privacy Policy (“Privacy Policy”).
This Privacy Policy tells you about our online collection, use and disclosure of information from you, both Non-Public Personal Information (“NPPI”) (such as name, company or organization, address, telephone number, fax number, e-mail address, Social Security or Tax Identification Number, and date of birth) and non-personal information. The terms of this Privacy Policy apply to all information collected by us on the Web Site.
Collection of NPPI
You will not be asked to create an account, username or password in order to access this Web Site. Therefore, any NPPI you choose provide to us is completely voluntary on your part. If you choose to contact us through a function on the Web Site, you will be asked to supply your name and e-mail address so that we may respond to your inquiry. You will also be required to submit your e-mail address and that of the recipient if you wish to e-mail an article or post to a friend, and you will be required to submit your e-mail address and create a username and password in order to post comments on our blog. It is your responsibility to keep any such password confidential, and we are not responsible for any activity or use of your NPPI resulting from a third party’s use of your password. Except for the information specified above, we do not require you to provide any NPPI.
Children’s Privacy
Individuals under eighteen (18) years of age are prohibited from using the Web Site by the CreditGumbo.com Use Agreement. We do not knowingly or intentionally collect any NPPI or other information from children. If you are under the age of 18 years, please do not use our Web Site.
The Use of Technology to Gather Information
We and our third-party service providers may collect information (but not NPPI) through technology to make our Web Site more interesting and useful to you and for various purposes related to our business. For instance, when you come to our Web Site, we may collect your IP address. An IP address is associated with the access point through which you enter the Internet, and is typically controlled by your Internet Service Provider (ISP), your company, or your university. Standing alone, your IP address is not personally identifiable. We may use IP addresses to collect information regarding the frequency with which our guests visit various parts of our Web Site. We do not combine IP addresses with NPPI.
In addition to IP addresses, we may collect other information through a variety of technical methods, including cookies and Web beacons. Cookies are pieces of information that a web site places on your computer while you are viewing the web site. Web beacons are small pieces of data that are embedded in images on the pages of web sites. Cookies, web beacons and other technical methods may involve the transmission of information either directly to us or to another party authorized by us to collect information on our behalf.
Through these technical methods, we may collect information on when you visit the site, what pages you view or access, session identification number, what type of browser you are using and other information that helps us and our service providers to improve the Web Site, personalize your online experience or present content of interest to you. We do not use cookies, Web beacons or other technical methods to collect NPPI from you, and we do not link or associate information that is gathered through these methods with your NPPI.
In addition, as a result of your visit to our Web Site, ad server or affiliate network companies may collect information such as your domain type, your IP address and clickstream information. Retention, Disclosure and Use of Your Information
We do not retain names, e-mail addresses or other NPPI provided to us by visitors to the Web Site, except for information which you choose to post or provide when using or registering to use a blog or other Interactive Area (as defined below). We do not share this information with any third parties (i.e., non-CreditGumbo.com personnel), except as specifically set out in this paragraph. We may disclose information to third-party service providers as necessary for them to perform functions for the Web Site, such as hosting and data storage. Those third-party service providers (i) shall be permitted to obtain only the NPPI they need, if any, to provide the service, and (ii) must protect NPPI to the same extent as we do, including not using it for any improper purpose. We may also disclose NPPI to cooperate with law enforcement authorities, a court or administrative agency, or other governmental authority in connection with an investigation or where otherwise required or permitted by applicable law. NPPI submitted in connection with Interactive Areas may be publicly viewable as described in the section below entitled “Forums and Other Interactive Services.” Finally, information about our visitors, including NPPI, may be disclosed as part of any merger, acquisition, or sale of KGW Gumbo, LLC and/or its assets, as well as in the unlikely event of insolvency, bankruptcy, or receivership, in which case NPPI would be transferred as one of the business assets of the company.
We will not use your name or e-mail address for any purpose other than to respond to your inquiry, process your request to e-mail an article or post to another person, or enable you to use our blog or other Interactive Areas. We will not use your or any other e-mail address submitted by you to send marketing or promotional e-mails; however, we may communicate with you regarding any request made by you or your use of our Web Site.
Information other than NPPI may be retained, used and shared for the purposes described in the section above entitled “The Use of Technology to Gather Information.”
Forums and Other Interactive Services
The Web Site may include discussion forums or other interactive areas or services, including blogs, chat rooms, bulletin boards, message boards, online hosting or storage services, or other areas or services in which you or third parties create, post or store any content, messages, comments, materials or other items on the Web Site (collectively, "Interactive Areas"). If you use an Interactive Area, you should be aware that these areas are open to the public and any NPPI you post or provide to identify yourself when registering to use such Interactive Area may be viewable by others. We are not responsible for NPPI you post or provide to identify yourself in connection with the Interactive Areas, nor are we responsible for how others might use that information, including to send you unsolicited messages. Interactive Area postings and may be retained indefinitely.
Security
The security of your information is important to us. We restrict access to any NPPI you provide (other than NPPI you choose to post on a blog or other Interactive Area of the Web Site) to persons with a legitimate need to see or access the information. We also take reasonable measures to safeguard any other information we collect from you. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to protect your NPPI and other information, we cannot guarantee its absolute security.
Third Party Sites and Advertisers
The Web Site may feature links to third-party websites, such as those of credit providers and advertisers, that have different privacy and security policies and practices from those disclosed here. If you choose to apply for credit or purchase products or services from any third-party sites or linked sites or advertisers, you may be asked to provide NPPI. Third-party linked sites and the sites of advertisers may also capture information through cookies, Web beacons and other technology. Any information you provide during, or that is captured as a result of, your visit to third-party web sites or third-party web pages is covered under the privacy policies of those third-party web sites, and we assume no responsibility for such sites or for their privacy and security practices, which may vary considerably from this Privacy Policy. You must review and agree to be bound by the privacy policy of any site you visit. You understand and agree that KGW Gumbo, LLC is not responsible in any way for the protection or treatment of any information that you provide during, or that is captured as a result of, your visits to third-party sites.
Changes to Our Privacy Policy
We reserve the right to change the terms of this Privacy Policy at any time. When we make changes, we will revise the "last updated" date at the top of the policy and post the changed policy on the Web Site. If there are material changes to this Privacy Policy or in how we will use or disclose your NPPI, we will notify you by prominently posting a notice of such changes here or on our home page, or by sending you an e-mail. Notwithstanding the foregoing, your provision of any information on or through the Web Site following any such change shall constitute your consent to the collection, disclosure and use of such information in accordance with the changed policy. Accordingly, we encourage you to review this Privacy Policy whenever you visit the Web Site in order to familiarize yourself with the most recent version.
